the pad with the papers

A legal dispute is looming between unions VHP2, FNV, CNV and the Union on the one hand and Thales on the other over the interpretation of the Metalektro HP collective labour agreement. What is it about?

Thales argues that a substantial number - around 300- of its employees are not covered by the CBA Metalektro HP because these employees are officers directly involved in determining company policy. Under Article 21 Annex A, these employees are then excluded from the CBA Metalektro HP. The VHP2 and the other unions involved argue that it cannot be the case that all these employees can be directly involved in determining company policy and that Thales is thus circumventing the HP CBA. As Thales takes the position that this category falls outside the CBA, these employees are also not eligible for the CBA increases.

How to proceed now?
The joint unions have asked their members to provide information showing that they hold positions without direct involvement in company policy. With this, we want to convince Thales to go back on its position. If Thales is unwilling to do so, unions are considering legal action.
