Enter into an employment contract

When am I entitled to a permanent contract?

Your employer makes you an offer. This is usually a contract for a definite period of time. The law states that a temporary contract automatically becomes a permanent contract if an employee has received more than 3 consecutive temporary contracts. However, deviating agreements can be made in a collective agreement, so it is always important to consult the collective agreement first.

Do I have to agree to a non-competition and non-solicitation clause in my employment contract?

You are not obliged to do so, but there is a chance that you will not be offered the job. It is important to consult with the new employer and try to make agreements about this.

A non-competition and non-solicitation clause may also be agreed with a contract for a definite period of time, but the employer must then substantiate in the employment contract that there are serious business and/or service interests.
